Terms of service

These terms and conditions, together with our Privacy Policy and any other policy referred to in these terms and conditions ("Terms"), apply to your use of and access to the Website. These Terms also apply to any contract between us for the sale of any product, including any order placed by you over the Website.

Please read these Terms carefully and make sure you understand them before ordering any product from our Website. You should save or print a copy of these Terms for future reference.

If you do not agree to these Terms, you must stop using and accessing this Website.

We may update these Terms for future orders. The Terms and offer conditions in place when you place an order will apply to that order, unless a change is required by law or you agree otherwise. Please check the current Terms before placing a new order and keep a copy for your records.

Use of Website

Your use of our Website is governed by these Terms, our Privacy Policy, and any additional policies referenced within. You agree that all information you provide when placing an order is true and accurate, and you will notify our customer service team of any changes to that information.

We only use your personal information for the purposes outlined in our Privacy Policy, including processing orders, payments and managing your account.

Eligibility

You must be at least 18 years old to purchase products from The Faux Flower Company. By placing an order, you confirm that you meet this requirement.

Website Availability

We take reasonable steps to ensure the Website is available and functioning correctly, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw or restrict access to the Website at any time for business, maintenance or operational reasons without notice.

Accuracy of Information

We work to keep product information, prices and stock availability accurate. If we discover a material error affecting your order, we will explain it and offer you the choice of proceeding on the corrected basis or cancelling for a refund. We will not make a material change to an accepted order without your agreement.

Content You Upload or Submit

Whenever you make use of a feature that allows you to upload content to our Website (including reviews, photographs or comments), or to interact with other users, you must comply with these Terms and all applicable laws.

You retain ownership of the reviews, photographs and comments you submit. When you submit content for publication as a customer review, you give us non-exclusive, royalty-free permission to host, reproduce, format and display that content on our Website as part of our customer reviews. We may use service providers to help us do this. Formatting or minor spelling corrections will not change the meaning of your review.

We will seek your separate permission before using your photographs in advertising, social media or other marketing campaigns. Submitting a review or photo does not by itself give that marketing permission. Private customer-service messages and photographs sent to resolve an order issue are not submitted for publication and are not covered by this permission.

We reserve the right (but are not obligated) to moderate, remove or refuse to display any content that we believe violates these Terms, infringes any third-party rights, or is unlawful, offensive or inappropriate.

If someone alleges that content you submit infringes their rights, we may investigate and take appropriate action. We will disclose identifying information only where we have a lawful basis and the disclosure is necessary and proportionate, for example to comply with a legal obligation or court order, or where otherwise lawfully justified in connection with a legal claim. A complaint alone does not automatically entitle the complainant to your personal information. We handle any disclosure in accordance with our Privacy Policy and applicable data-protection law.

Prohibited Uses

You must not misuse our Website. This includes (but is not limited to):

  • Introducing viruses, trojans, worms, logic bombs or other harmful material.
  • Attempting to gain unauthorised access to our Website, server or connected systems.
  • Scraping, extracting or harvesting data without our consent.
  • Using the Website for fraudulent, harmful or illegal purposes.
  • Interfering with the Website’s operation or security.

Device & Browser Compatibility

We make reasonable efforts to ensure the Website displays correctly across modern browsers and devices, but we cannot guarantee compatibility with all software, operating systems or hardware. Some features may not function correctly if you are using outdated or unsupported technology.

Refusal of Access

We may deny you access to the Website at any time, at our sole discretion, if we believe that your use of the Website violates these Terms, any applicable law, the rights of any third party, or is otherwise inappropriate or harmful.

Responsibility for Submitted Content

You must have the right to share content you submit and must not submit unlawful material or infringe another person's rights. Any liability for your conduct is determined by applicable law; these Terms do not require you to cover every claim or cost associated with using the Website.

Promotional Offers & Discount Codes

From time to time, The Faux Flower Company may run promotions, discount codes or special offers on selected products. All promotions are offered entirely at our discretion and may be subject to additional terms which will be communicated at the time.

Unless stated otherwise, all promotional offers are subject to the following conditions:

  1. Promotions are valid on full-priced items only and cannot be used on sale or discounted products unless explicitly stated.
  2. Promotions and discount codes cannot be used in conjunction with any other offer and are valid only for the period specified in the corresponding communication.
  3. Only one promotion or discount code may be applied per order and per customer, unless otherwise stated.
  4. Some promotions may require a minimum spend, which will be clearly specified where applicable.
  5. We reserve the right to substitute any free gift or promotional item with a product of equal or greater value if the advertised item becomes unavailable.
  6. Promotions are not valid in our outlet store unless explicitly stated.
  7. Returns of discounted products and promotional gifts are handled under our Refund Policy, including its rules on previously disclosed gift values and lawful deductions.
  8. Offers are subject to the availability and closing dates stated in the offer. We may change, extend or withdraw an offer for future orders, but this will not remove a valid promotional benefit from an order already placed.
  9. Discount codes must be applied during checkout and cannot be added retrospectively to an order after it has been placed.
  10. Promotions have no cash value and cannot be exchanged for cash, credit or alternative products unless expressly stated.
  11. Any redemption limits will be stated in the offer or these Terms before you order. We may enforce those limits and refuse deliberate attempts to evade them, but will not introduce a new limit retrospectively to remove a valid benefit from an order already placed.
  12. If a genuine pricing or technical error affects a promotion on your order, we will explain it and offer you the choice of proceeding on the corrected basis or cancelling the affected order for a refund. We will not increase the amount charged or make a material change without your agreement. This does not remove rights arising from a contract already formed.
  13. Promotions and discount eligibility do not change based on payment method, including Klarna or other buy-now-pay-later services. Choosing a pay-later option does not extend or alter promotional validity periods.
  14. Price adjustments will not be applied retrospectively. If a product is reduced in price or placed on promotion after your purchase, we are not able to refund the difference.

One-Time Use & New Customer Offers

New-customer offers are limited to one redemption per household, billing address or delivery address. A household or address that has already used a new-customer offer cannot qualify again by using a different person, email address or account.

Other discount codes described as 'one-time use' may be redeemed once per customer, subject to the specific offer terms. Eligibility is determined by customer identity, order history, relevant addresses and account activity, not solely by email address.

Creating multiple accounts, using alternative email addresses or identities, or placing multiple orders to get around an offer's eligibility or redemption limits is not permitted.

Where these eligibility rules are not met, we may refuse the discount or cancel the order and refund any payment taken. We will not charge a higher price without your agreement.

Free Gifts with Orders

From time to time, we may offer complimentary products, digital rewards or gift vouchers with qualifying purchases (“Free Gift Promotions”). Unless otherwise stated at the time of the offer, the following terms apply.

Eligibility

Free-gift eligibility is based on the qualifying product total after discounts. Paying with a purchased gift voucher counts as payment and does not reduce qualifying spend. Buying a gift voucher does not count towards the threshold, and delivery charges are excluded. Promotional vouchers are subject to the qualifying-spend rules stated in their offer. Unless the offer says otherwise, Free Gift Promotions apply to UK orders only.

Gift Types

Free gifts may include physical products, digital items, or gift vouchers. Where different gift levels are offered, the gift you receive will depend on your final qualifying spend. Details will be clearly communicated during the promotional period.

How Gifts Are Issued

Free gifts will be automatically added to qualifying orders at £0, unless otherwise stated. For gift vouchers, details will be sent electronically to the email address provided at checkout.

Use of Existing Gift Vouchers

You can pay for qualifying products with a purchased gift voucher and still qualify for a free gift. Gift-voucher purchases themselves remain excluded from qualifying spend. Any separate restrictions on promotional vouchers are stated in the relevant offer.

Expiry (Gift Voucher Promotions Only)

Where the free gift is a gift voucher, it will be valid for 12 months from the date of issue unless stated otherwise.

Substitutions

If a promotional gift becomes unavailable, we reserve the right to substitute it with an item of equal or greater value.

Returns & Adjustments

If items are returned and your adjusted order total falls below the qualifying threshold for the free gift, the promotional gift must also be returned unused and in original condition.

If the gift is missing, we will contact you and give you a reasonable opportunity to return it. If you choose to keep it or do not return it, we will deduct its value where permitted by law. The qualifying conditions, gift value and deduction rule must have been clearly stated before purchase. The deduction cannot exceed the stated value or the refund due and will not be an arbitrary penalty. Unused promotional voucher balances can be cancelled instead; any adjustment for a redeemed voucher follows the rules disclosed before purchase. See our Refund Policy.

Exclusions

  • Gift voucher purchases do not count towards qualifying spend.
  • Delivery charges do not count towards qualifying spend.
  • Free gifts cannot be exchanged for cash, credit or alternative products.
  • Promotional gift vouchers cannot be used to purchase other gift vouchers.

Fraud & Misuse

We may investigate where we have reasonable grounds to suspect fraud, deliberate attempts to evade an offer's qualifying conditions, technical manipulation or unauthorised access. We may temporarily restrict an affected promotion or account while carrying out proportionate checks. A large or bulk purchase does not by itself constitute misuse; any quantity or redemption limit must have been stated in the offer before purchase.

Free gifts, promotional products and promotional gift vouchers are issued only with qualifying purchases. They cannot be claimed independently of a qualifying transaction or exchanged for cash. This does not mean a physical gift has no value: if a return removes eligibility and the gift is kept, the previously disclosed gift value may be deducted only in accordance with our Refund Policy. Promotional vouchers remain subject to their stated redemption conditions.

Where an order does not meet the disclosed qualifying conditions, or a promotional benefit was obtained through fraud or deliberate misuse, we may remove the invalid promotional gift, cancel an unearned promotional voucher or refuse its redemption. We will explain the action taken unless the law prevents us doing so. Genuine technical or pricing errors are handled under the corrected-order or refund procedure above.

We will not increase an order's price or make a material change without your agreement. If we cannot fulfil an affected order, we will notify you and refund the amount due. Any deduction from a refund must be permitted by law, explained and consistent with the previously disclosed offer conditions and our Refund Policy; it cannot be an arbitrary penalty. These provisions do not remove a valid benefit from a qualifying order or limit statutory rights.

Orders

By placing an order with us, you agree to and accept these Terms. If you are unclear about any aspect of these Terms, please contact our customer service team on 01242 352059 (Monday–Friday, 9am–4pm), by email at [email protected], or by post using the address provided on this Website.

When you place an order via our Website, you are making an offer to The Faux Flower Company to purchase the goods detailed in your order. Where delivery is requested, you are also making an offer for us to deliver those goods under the terms described at checkout.

After placing your order, you will receive an email acknowledging that we have received it. This does not constitute acceptance of your order. A contract between you and The Faux Flower Company is formed only when the order has been accepted, processed and dispatched.

We will take payment at the point your order is placed, whether you choose to pay by debit or credit card, PayPal, Apple Pay, Google Pay, Klarna or any other payment method offered at checkout. This does not affect your statutory rights.

Before accepting an order, we may decline it on reasonable grounds, for example if a product is unavailable or we reasonably suspect fraud. Pricing and product-information errors are handled as explained below. If we decline or cannot fulfil an order, we will notify you and refund any payment taken for the cancelled goods and any delivery charge that no longer applies. Your rights concerning an order we have already accepted are unaffected.

Prices and availability may change for future orders. If a genuine pricing or product-information error affects an order already placed, we will explain it and offer the choice of proceeding on the corrected basis or cancelling the affected order for a refund. We will not charge a higher amount or make a material change without your agreement. This does not remove rights arising from a contract already formed.

Stock Availability

We aim to keep stock information accurate. If an item becomes unavailable after you order, we will contact you as soon as possible with the expected availability or dispatch date, if known. You can choose to wait or cancel the affected item for a refund. If we cannot give an expected date, we will tell you. We will not treat silence as agreement to wait or extend an agreed delivery deadline. Your legal rights to cancel the rest of the order where applicable are unaffected.

Bouquet and Arrangement Substitutions

We reserve the right to make occasional minor substitutions of unavailable stems within bouquets and arrangements. Any substitute must be an equivalent stem of equal or greater quality and value, at no extra charge. We will preserve the overall style, colour palette, stem quantity and advertised main characteristics of the arrangement.

This does not permit a material change to the advertised design or substitution of a separately selected stem, vase or other product. If a suitable equivalent is unavailable or the proposed change would materially alter the design, we will contact you for agreement before dispatch. You can decline and receive a refund for the affected product. This clause does not limit your rights to cancel or return goods, or your remedies for faulty or misdescribed goods.

Product Colours & Appearance

Screen settings and lighting can affect how colours appear. Handmade products may have small variations in finish or dimensions. Products must still match their description and advertised main characteristics. These points do not remove your rights if goods are faulty or misdescribed.

Pre-Orders

From time to time, we may offer products on a pre-order basis. Estimated dispatch dates for pre-order items will be shown on the relevant product page and/or at checkout. These dates are indicative only and may change due to unforeseen delays in production or shipping. If the expected dispatch date changes significantly, we will notify you as soon as reasonably possible.

Orders containing both in-stock and pre-order items are normally dispatched together when the pre-order item becomes available. If you would like in-stock items to be shipped sooner, please contact us at [email protected] and we will be happy to assist. We will confirm any additional delivery charge for separate dispatch with you first.

Payment for pre-order items is taken at the time the order is placed, not at the time of dispatch. Your statutory rights are not affected.

Delivery

Delivery services, charges and timeframes are explained in our Shipping Policy, which forms part of these Terms. Our delivery guide provides practical information.

For in-stock orders placed before 12 noon UK time on a working day, advertised delivery windows run from the date of order. After noon, at weekends or on a bank holiday, count from the next working day. Pre-order timing is shown on the product page.

If a paid next-day or Saturday service misses its promised day through no fault of the customer, we refund the extra cost above the standard service available for that order when contacted. If standard delivery was free, we refund the full upgrade charge. This is additional to any legal remedy for late delivery.

Estimated dates do not exclude statutory rights relating to late delivery. We remain responsible until the goods are physically received by you or someone you nominate, subject to the legal exception for a carrier independently appointed by you that we did not offer. The Shipping Policy explains the procedure for late, missing or damaged parcels and takes precedence over conflicting delivery wording in these Terms.

Minimum order value

Minimum goods values for delivery depend on the destination:

  • United Kingdom, including Northern Ireland: £5.
  • Jersey, Guernsey and the Isle of Man: £30.
  • Republic of Ireland: €30.
  • United States: US$50.
  • Other eligible destinations listed in our Shipping Policy: £50, or the checkout-currency equivalent.

The available delivery service, applicable minimum and final charge are confirmed at checkout. These delivery minimums do not apply to gift vouchers sent by email.

Conformity of Goods

Products must be of satisfactory quality, fit for any purpose agreed with us and match their description. The limited equivalent-stem substitutions explained above do not remove these rights. Our Refund Policy explains what to do if something is wrong.

Returns, Refunds and Cancellation

Our Refund Policy forms part of these Terms and explains your statutory cancellation rights, faulty-goods rights, return costs, refund deadlines and our 30-day Happiness Guarantee. It takes precedence over any conflicting returns or refund wording elsewhere in these Terms, including promotional and international-return provisions.

Request a change-of-mind return within 30 days of delivery and send the goods back within 14 days of your request. Packs and arrangements sold as one product must be returned complete. Separately purchased products can be returned from a larger order. Qualifying standard bouquet and arrangement returns include the optional hand-tying fee throughout the 30-day guarantee. Standard hand-tying does not make an item bespoke.

Our extended guarantee covers complete, unused goods in their original condition, apart from gentle inspection. You may unwrap and gently position flowers in a vase. Avoid cutting, substantial reshaping, untying or dismantling until you decide to keep them. Original packaging is preferred, but suitable protective alternatives are accepted.

For eligible UK and EU online purchases, the statutory cancellation period ends 14 days after the day you receive the goods, or the last item of an order delivered in separate parts. You may also cancel before delivery. A clear cancellation notice is enough; prior approval is not required. Return goods within 14 days of that notice.

For full statutory cancellations, we refund the price paid and the least expensive standard delivery charge available for the order. Original delivery is not refunded for change-of-mind requests on days 15–30 or partial returns unless required by law. You pay change-of-mind return postage; we cover reasonable return costs for faulty, damaged or misdescribed goods.

We aim to issue refunds within 2 working days of receiving returns; allow up to 5 working days after issue for funds to appear. Statutory cancellation refunds are due without undue delay and within 14 days of receiving the goods back or proof of sending, whichever is earlier. Different statutory deadlines apply where we collect the goods or refund faulty goods, as explained in the Refund Policy.

Refunds reflect the price actually paid after discounts. Any deduction for reduced value on statutory cancellation must be permitted by law and reflect handling beyond what is necessary to establish the goods’ nature, characteristics and functioning. We do not impose a restocking or cancellation fee.

Contact [email protected]. Returns go to The Faux Flower Company, Unit 37, Lansdown Industrial Estate, Cheltenham, GL51 8PL, United Kingdom. See our returns guide for practical instructions.

Misuse of the Guarantee

Where there is clear evidence of repeated use of goods followed by returns, such as using flowers for events and returning them afterwards, we may decline future orders. We assess each case individually; genuine returns are not misuse simply because they are frequent or high-value. This does not retrospectively remove the guarantee on accepted orders or limit statutory rights. Returned condition is assessed under our Refund Policy.

VAT, Customs & International Duties

VAT

VAT treatment depends on the delivery destination and applicable tax rules. Goods sent from Great Britain to the Isle of Man are treated as domestic supplies for VAT purposes. Goods sent to the Channel Islands or other overseas destinations may be zero-rated for UK VAT where the export conditions are met; destination taxes may still apply. Checkout shows any taxes collected by us. The absence of UK VAT does not mean that an order is free of all taxes, and refunds of taxes are handled under our Refund Policy.

Customs & Import Duties

Our Shipping Policy and checkout explain whether import duties and taxes are included or prepaid for your destination, or payable separately by you. Where we state that these charges are included or prepaid, we arrange their payment and you should not be asked to pay them again on delivery. If a courier asks for an unexpected payment, contact us so we can check it.

Where import charges are payable separately by you, this will be made clear before purchase. Customs authorities or the courier may collect the applicable charges before releasing the parcel. We do not pass on import charges that we promised were included or prepaid.

Refusal to Pay Duties

If you decline import charges that were clearly stated before purchase as your responsibility and the parcel is returned to us, we may deduct only reasonable, evidenced return costs that we are legally entitled to recover and that were disclosed as your responsibility before purchase. We will explain any proposed deduction. We will not pass on costs caused by our error or demand payment of import charges that we promised were included or prepaid. Refunds and any deductions remain subject to our Refund Policy and your statutory rights.

International Returns

Contact us for accurate customs instructions before returning goods to the UK. Identify the parcel as returned goods and include original order details where required; do not declare British origin solely because the goods were bought from us. Taxes, duties, return postage and any refund adjustments are handled under our Refund Policy. We do not impose a blanket deduction for unrecovered customs charges, and statutory refund deadlines and rights are preserved.

Gift Cards & E-Gift Cards (“Gift Tender Terms”)

The Faux Flower Company gift cards and e-gift cards (“Gift Tender”) can be redeemed online and are subject to these Terms in addition to our general Website Terms and Conditions.

Use of Gift Tender

Gift Tender may be used as full or part payment for any eligible products. If the value of your purchase exceeds the balance of the Gift Tender, the remaining amount must be paid using another accepted payment method.

If you return a purchase paid for partly or fully with Gift Tender, the amount paid using Gift Tender is refunded to gift-voucher credit. Any refundable amount paid using another payment method is returned to that method. Our Refund Policy explains the applicable refund rights and deadlines.

Restrictions

  • Gift Tender cannot be resold, transferred for value, exchanged for cash or used to purchase other gift cards.
  • No cash change or balance will be given.
  • Gift Tender is not a credit, charge or debit card.

Lost, Stolen or Damaged Gift Tender

Keep your gift-voucher email and code secure. If the email or code is lost, stolen or damaged, contact [email protected]. Once we verify the original purchase, we will help you recover or resend the remaining unused balance. We do not reimburse value already spent by someone else, except where required by law.

Validity

Unless stated otherwise, Gift Tender is valid for 12 months from the date of issue. Once expired, any remaining balance will be void and cannot be redeemed.

Fraud & Misuse

We reserve the right to refuse, cancel or block the use of any Gift Tender that we reasonably believe has been obtained, used or activated fraudulently, unlawfully, or in breach of these Terms.

Technical Issues & Force Majeure

If a technical issue prevents you from using a gift voucher, contact us for help. We will take reasonable steps to restore access as soon as possible. This does not limit your legal rights or our responsibility under the Our Responsibility to You section below.

Changes to Gift Tender Terms

The Gift Tender Terms in place when a gift voucher is issued continue to apply to that voucher, unless a change is required by law or you agree otherwise. We may update the Terms for vouchers issued in future. Our existing Fraud & Misuse provisions still apply.

Precedence

The remainder of our general Terms apply to all purchases made using Gift Tender. In the event of any conflict between these Gift Tender Terms and the general Terms, these Gift Tender Terms will take precedence.

Our Responsibility to You

We are responsible for loss or damage that is a reasonably foreseeable result of our breach of contract or failure to use reasonable care and skill. A loss is foreseeable if it is an obvious result or was reasonably contemplated by both of us when the contract was made.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that the law does not allow us to exclude or limit.

For consumer purchases, we are not responsible for business losses such as lost business profits or business opportunities. This does not impose a cap on remedies you are entitled to under consumer law.

If an event outside our reasonable control affects an order, we will contact you and take reasonable steps to reduce the delay. Your cancellation, delivery and refund rights remain available; we do not retain payment for goods we cannot supply.

Copyright & Intellectual Property

All content on this Website—including text, images, designs, graphics, photographs, logos and other materials—is owned by or licensed to Amaranthine Home Ltd and is protected by copyright and intellectual property laws. All rights are reserved.

You may:

  • View, print or download extracts of content for personal, non-commercial use; and
  • Share content with individual third parties for their personal information, provided you do not modify the material, take commercial advantage of it, or remove any copyright notices, and that you acknowledge The Faux Flower Company as the source.

You may not copy, reproduce, modify, distribute, publish, display or exploit any part of this Website for commercial purposes without our prior written permission.

Text messaging

If you opt in to marketing by text, we may send you promotions and cart reminders by SMS or, where available, RCS. Marketing consent is optional and is not a condition of purchase.

Message frequency varies, and your mobile provider's message or data charges may apply. To stop marketing texts, follow the opt-out instructions in the message, such as replying STOP where replies are supported or using the unsubscribe link provided. You can also contact [email protected] for help or to opt out.

Essential messages about an order or delivery are separate from marketing. Opting out of marketing does not prevent us from sending necessary, non-promotional service communications using an appropriate contact method. Our Privacy Policy explains how we handle your information and messaging preferences.

Accuracy, Availability & External Links

We take reasonable steps to keep Website information accurate and up to date, but cannot guarantee uninterrupted or error-free access. This does not remove your rights concerning purchased products or exclude responsibility we owe under the Our Responsibility to You section above.

Where our Website contains links to third-party sites, these are provided for convenience only. We do not control or endorse third-party content and accept no responsibility for their availability, accuracy or functionality.

Governing Law & Jurisdiction

These Terms and your use of the Website are governed by English law. You agree to submit to the non-exclusive jurisdiction of the English courts. This does not affect your statutory rights as a consumer.

We are based in England, United Kingdom, and supply customers in the destinations available through our checkout. Our choice of English law and non-exclusive English courts does not deprive consumers of any mandatory protections under the law that applies to them or any right to bring proceedings in other courts available to them under that law.

Assignment & Third-Party Rights

We may transfer our rights and obligations under these Terms to another organisation only where this does not reduce your rights or guarantees under your contract. We will tell you about a transfer that affects an existing order. You may transfer your contractual rights or obligations with our written agreement, which we will not unreasonably withhold. This does not affect any rights that pass to another person by law.

No person other than you and The Faux Flower Company shall have any rights to enforce any of these Terms under the Contracts (Rights of Third Parties) Act 1999.
